Apple controls which applications receive the most visibility through the App Store. Musk accuses the company of using this very control to disadvantage its own apps, such as Grok or Platform X. Instead, OpenAI apps are given preferential placement. Observations show that ChatGPT has been prominently advertised on Apple's platform for months. At the same time, there is a close collaboration between Apple and OpenAI to integrate ChatGPT into Siri. Musk considers this a clear violation of fair competition.

The central allegation is that Apple isn't including Grok in the App Store's recommended section, even though the app has already reached number 5 on its own. ChatGPT, on the other hand, has been highlighted for months and enjoys a ranking that other AI apps don't achieve. Musk sees this as a structural advantage for OpenAI, making it almost impossible for competitors like xAI to rise to the top. The connection between Apple and OpenAI is no secret. For Musk, this isn't just a technological project, but also clear evidence of favoring one partner in the App Store.

The announced lawsuit against Apple is likely only part of a broader dispute. Musk is already involved in a separate legal dispute with OpenAI. This concerns the question of whether OpenAI was permitted to transform from a non-profit organization, which he co-founded, into a commercial provider. Musk argues that his investments were made under false pretenses. He accuses OpenAI of abandoning its original mission – an action he considers fraudulent. The court has allowed the lawsuit because the allegations are sufficiently substantiated. Whether this is actually about the original non-profit status or whether Musk primarily wants to regain control remains to be seen. Industry observers, however, see the attacks on Apple as a deliberate strategy to limit OpenAI's dominance by any means necessary.
